Beurteilungsspielraum

Beihilferegelung
mit
den
Anforderungen
des
Gemeinsamen
Marktes
einräumt,
dass
dieses
Verfahren
jedoch,
wie
sich
aus
Sinn
und
Zweck
des
Vertrags
ganz
allgemein
ergibt,
niemals
zu
einem
Ergebnis
führen
darf,
das
mit
den
besonderen
Vorschriften
des
Vertrags
im
Widerspruch
steht
