this
question
the
Commission
has
in
my
view
convincingly
shown
that,
even
if
only
a
deduction
of
the
transport
costs
from
the
place
of
introduction
to
the
place
of
destination
is
involved
—
because
of
course
pursuant
to
Article
1
(2)
(b)
of
Regulation
No
803/68
it
has
to
be
assumed
that
the
seller
bears
all
costs,
charges
and
expenses
incidental
to
the
delivery
of
the
goods
at
the
place
of
introduction
—
that
deduction
nevertheless
properly
depends
on
evidence
of
a
certain
freefrontier
price,
that
is
a
price
which
includes
all
costs
to
the
frontier.
Dazu
hat
die
Kommission
meines
Erachtens
überzeugend
dargelegt,
daß
es,
auch
wenn
nur
ein
Abzug
der
tatsächlichen
Beförderungskosten
vom
Ort
des
Verbringens
bis
zum
Bestimmungsort
in
Be
tracht
kommt
—
weil
ja
nach
Artikel
1
Absatz
2
Buchstabe
b
der
Verordnung
Nr.
803/68
davon
auszugehen
ist,
daß
der
Verkäufer
alle
Kosten
trägt,
die
sich
auf
die
Lieferung
der
Waren
am
Ort
des
Verbringens
beziehen
—,
doch
zu
Recht
auf
den
Nachweis
eines
bestimmten
Frei-Grenze-Preises
ankommt,
also
eines
Preises
unter
Einschluß
aller
Kosten
bis
zur
Grenze.
