This applies in particular to claims for compensation resulting from mistakes on conclusion of contracts, due to other breach of obligations or due to liability-in-tort claims of compensation for material damages in accordance with § 823 of the German Civil Code.

This shall apply in particular for compensation claims for damages resulting from culpability at the time of contract conclusion for other breaches of duty or for offence claims to compensation for damages to property according to § 823 BGB (German Civil Code).

In particular, this applies to claims for damage resulting from culpa in contrahendo at the time of conclusion of the contract, on the grounds of other breaches of obligation or of tortious claims for material damage in accordance with clause 823 BGB.

This applies, in particular, to damage claims for negligence when entering into the contract, for any other violations of duty or for tortuous claims and the compensation of damages pursuant to Section 823 BGB.

This applies specifically in the case of claims for damages due to infringement of pre-contractual obligations, or other breach of duty, or tortious claims for indemnity of damages pursuant to § 823 BGB.

This shall particularly apply for claims to damages on account of culpa in contrahendo, positive violation of contractual duties or claims from tort.

This applies in particular to claims for damages arising from negligence on conclusion of the contract, other breaches of obligation or tortious claims for compensation for property damage (in the application of German law within the meaning of § 823 German Civil Code).

This applies in particular to damage claims due to faults at the time of signing the contract, any other breach of duty or actions in tort for compensation of material damage as per § 823 BGB.

More extensive contractual and tortious claims of the orderer are excluded.

Further and tortuous claims of the ordering party are excluded.

This applies to contractual and non-contractual (tort) claims.

This also ap­plied, in particular, to the question whether an agreement on jurisdiction contained in a contract covered claims not only in contract but also in tort, in so far as the latter re­lated to the contractual relations between the parties.

12.3 Mandatory statutory provisions exist in any case, whether contractual or tort claims by the Customer for compensation not caused to the object of delivery itself. This includes production, loss of use, loss of contracts, unrealized savings, lost profits, or any other direct or indirect damage.

Clarity is also needed with regard to non-contractual claims, such as when a citizen of one Member States is injured in a traffic accident in another Member State.
