If the seller becomes aware of circumstances which call the credit worthiness of the purchaser into question, in particular if the latter does not honour a cheque or stops payment, or if the seller becomes aware of other circumstances which call credit worthiness into question, the seller shall be entitled to declare that the whole of the outstanding debt is immediately due even if the seller has previously accepted cheques.

In the event of justified doubts concerning the creditworthiness of the customer, in particular if the customer should fail to honour a cheque or if he should cease payments, we shall have the right to make all outstanding amounts due for payment immediately even if we have accepted cheques.

Should the Vendor become aware of circumstances which place the purchaser’s creditworthiness in doubt, in particular should the purchaser fail to honour a cheque or cease to make payments, then the Vendor will be entitled to declare the entire remaining sum payable, even if he has accepted cheques.

In the event that our contracting party does not meet the financial obligations, in particular does not honour a cheque or ceases payments or if we obtain knowledge of other circumstances which challenge the creditworthiness of our contracting party, we are then entitled to immediately accelerate maturity of all outstanding claims irrespective of agreed terms of payment, even when we have accepted cheques.
